UPDATE: Clancy’s Attorney Seeks Dismissal After Mistrial

Lindsay Clancy’s attorney says he will ask a judge to dismiss the murder case against her and prevent prosecutors from holding a second trial.

Defense attorney Kevin Reddington said he plans to file the motion during a court hearing scheduled for September 29.

Defense Raises Double Jeopardy Argument

Reddington said the request will be based on double jeopardy grounds, arguing that there was no “manifest necessity” for declaring a mistrial.

The highly publicized trial ended in a mistrial on September 4 after jurors failed to reach a unanimous verdict following more than seven days of deliberations.

The jury was reportedly divided 11–1, with the foreperson alleging that the lone holdout juror acknowledged having reasonable doubt but refused to apply it when considering the verdict.

Prosecutors Have Not Announced Retrial Decision

Clancy was charged in connection with the 2023 deaths of her three young children at their home in Duxbury, Massachusetts.

Her defense argued that she was suffering from postpartum psychosis and was not criminally responsible. Prosecutors maintained that she understood her actions and planned the killings.

Prosecutors have not yet announced whether they will pursue a second trial. Clancy remains in custody while receiving psychiatric and medical treatment.
