Maurene Comey’s Firing Ruled Unlawful by New York Judge, Who Orders Retroactive Reinstatement

A federal judge in New York ruled Monday, October 26, that the Trump administration unlawfully fired prosecutor Maurene Comey and ordered her retroactive reinstatement.

U.S. District Judge Jesse Furman found that her dismissal violated civil service protections.

Ruling Concerns Back Pay and Retirement Benefits

Comey, the daughter of former FBI Director James Comey, was dismissed from the Manhattan U.S. Attorney’s Office in July 2025.

She sought reinstatement retroactively through December 2025 to receive back pay and qualify for retirement benefits. The relief concerns her employment record for that period, rather than a return to prosecuting cases now.

Comey Challenged Her Dismissal

In her lawsuit, Comey alleged that she was fired because of her father’s identity, in violation of protections against politically motivated dismissals.
