Official response and confirmed impact

Nebraska is redoubling its attempt to block low-income food stamp recipients from using their federal benefits to purchase foods it deems unhealthy, including soda, energy drinks, and candy, after a federal judge vacated its first try.

The state in September sought approval from the US Department of Agriculture for a pilot project implementing the restrictions under the Supplemental Nutrition Assistance Program, according to a notice the department posted Thursday seeking public comment.

The department cited a federal court ruling that in June vacated similar pilots in Nebraska and four other states.
