Supreme Court Allows Republican Committees to Buy Discounted TV Ads Before 2026 Midterms

The U.S. Supreme Court granted an emergency Republican appeal Friday, allowing political party committees to purchase discounted television and radio advertising ahead of the 2026 midterm elections.

The order temporarily blocks a lower-court decision that restricted the reduced rates to individual candidates.

Discounted Political Ads Restored

Federal law requires broadcasters to offer candidates their lowest advertising rates during the 60 days before a general election.

The Federal Communications Commission extended that benefit to party committees purchasing advertisements coordinated with candidates. Democratic candidates challenged the policy and initially persuaded an appeals court to block it.

Supreme Court Intervenes

The Supreme Court’s order restores the FCC policy while Republicans pursue a further appeal.

Justice Ketanji Brown Jackson dissented from the decision, arguing that the court should have waited for the FCC to complete its review.

Decision Could Affect Midterm Campaigns

The ruling could significantly reduce advertising costs for Republican congressional and Senate committees entering the final stretch of the November midterm campaigns.

The decision is temporary and does not resolve the underlying legal dispute over whether political parties are entitled to the same discounted rates as candidates.
