Hazmat Transport Drivers Can Proceed With Wage Deduction Claim

Grammer Logistics Inc. failed to quash two delivery drivers’ proposed class action accusing the company of taking deductions from their pay in violation of New Jersey law, a federal judge ruled.
Daquan Beard and Allen Stembridge plausibly alleged the hazardous materials transportation company misclassified its drivers as independent contractors instead of employees, which would make its deductions from their wages unlawful, Judge Sarah Evans Barker wrote Wednesday for the US District Court for the Southern District of Indiana.
